London Rubbish Removal Service Terms and Conditions

These Terms and Conditions set out the basis on which London Rubbish Removal provides waste and rubbish collection services. By booking a collection or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 London Rubbish Removal, we, us, our: The waste and rubbish collection service provider supplying services to you.

1.2 Customer, you, your: The person, business, company or organisation requesting and paying for the rubbish removal or associated services.

1.3 Services: Any rubbish removal, waste collection, clearance, loading, transportation, disposal or related services provided by us.

1.4 Premises: The property, land, building, unit or site where the waste is to be collected.

1.5 Waste: Any furniture, household items, commercial waste, construction waste or other materials presented for collection, excluding Prohibited Waste.

1.6 Prohibited Waste: Any hazardous, dangerous, restricted or regulated materials, including but not limited to chemicals, asbestos, clinical waste, solvents, oils, gas bottles and pressurised containers, unless expressly agreed by us in writing in advance and handled in accordance with law.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services, including collection, loading, transport and lawful disposal or recovery of waste.

2.2 Our services are generally offered for domestic, commercial, office, retail and light construction sites, subject to access, safety and compliance with waste regulations.

2.3 We reserve the right to refuse to carry out any service where it would be unsafe, unlawful, impractical, or where the waste includes Prohibited Waste not previously disclosed and agreed.

2.4 All services are provided subject to vehicle access, reasonable loading distances and compliance with any applicable site rules or building regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email or online booking form, where available. A booking is not confirmed until we have provided written or electronic confirmation.

3.2 When making a booking you must provide accurate information, including location of the premises, access details, type and approximate volume or weight of rubbish, and any special requirements.

3.3 Quotations may be provided based on your description of the waste. All quotations are estimates only and may be adjusted on arrival if the description, volume, weight or nature of the waste differs from that originally provided.

3.4 At the time of collection our operatives will assess the waste and confirm the final price before loading. If you choose not to proceed, cancellation charges may apply in accordance with these Terms and Conditions.

3.5 By confirming a booking, you warrant that you are the owner of the waste or are otherwise authorised to arrange removal of the waste from the premises.

4. Access and Customer Obligations

4.1 You must ensure that we have safe and reasonable access to the premises and to the waste to be collected, including any necessary parking permissions, loading areas and entry codes or keys.

4.2 You must ensure that the waste is clearly identified and separated from any items not intended for removal. We accept no liability for the removal of items that were not clearly identified as being excluded from the collection.

4.3 You must notify us in advance of any access restrictions, building regulations, loading time limits or other site-specific rules that may affect the provision of the services.

4.4 If access is restricted or delayed for reasons beyond our control, additional waiting time charges or aborted collection charges may apply.

4.5 You agree to provide a safe working environment for our operatives, including clear pathways, adequate lighting and the absence of aggressive behaviour or dangerous conditions.

5. Pricing and Payment

5.1 Pricing is generally based on the volume or weight of waste collected, the type of waste, any additional labour required and any applicable disposal or recycling charges.

5.2 Prices will be confirmed on site before loading. If you agree to the price and the collection proceeds, you will be liable to pay the full amount due.

5.3 Unless otherwise agreed in writing, payment is due immediately upon completion of the collection. We may accept cash, card or other agreed payment methods.

5.4 For business customers with approved accounts, payment terms will be as agreed in writing and may be subject to credit checks and limits.

5.5 All prices are exclusive of VAT unless stated otherwise. Where VAT is applicable it will be charged at the prevailing rate.

5.6 If you fail to pay any sums due on time we reserve the right to charge interest on the overdue amount at the statutory rate, together with any reasonable costs incurred in recovering the debt.

6. Cancellations and Amendments

6.1 You may cancel or amend your booking by contacting us directly. Cancellation is only effective once we have confirmed receipt of your request.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.

6.3 If you cancel within 24 hours of the scheduled collection time, or if we attend the premises and are unable to complete the service due to reasons within your control, we may charge a cancellation or call-out fee to cover our costs.

6.4 In the event of severe weather, traffic disruption, vehicle breakdown, staff illness or other events beyond our reasonable control, we may need to reschedule or cancel your booking. In such cases we will not be liable for any loss or inconvenience but will seek to arrange an alternative collection time as soon as reasonably possible.

7. Waste Regulations and Duty of Care

7.1 We operate in accordance with applicable waste management legislation and regulations, including the duty of care to ensure waste is handled and transferred responsibly.

7.2 By using our services you confirm that the waste presented for collection is accurately described, and you agree to cooperate with us in completing any required documentation relating to the transfer of waste.

7.3 We will transport and dispose of waste only at authorised waste management facilities and will take reasonable steps to maximise reuse and recycling where possible.

7.4 You must not include Prohibited Waste in any rubbish presented for collection unless we have expressly agreed in advance to accept such waste in accordance with applicable regulations.

7.5 If we discover Prohibited Waste among your rubbish, we may refuse to collect it, adjust the price to cover any additional handling or disposal requirements, or require you to remove such items. We may also be required to report certain materials to the relevant authorities.

7.6 You remain responsible for any failure to comply with waste regulations arising from your misdescription or concealment of waste, and you agree to indemnify us for any fines, penalties, charges or losses resulting from such non-compliance.

8. Customer Property and Site Condition

8.1 We will take reasonable care when carrying out waste removal services on your premises. However, some minor scuffs, marks or disturbance may occur when moving large or bulky items.

8.2 You are responsible for protecting floors, walls, doors, fixtures, fittings and any delicate surfaces or items that may be at risk during the collection process.

8.3 We are not responsible for any pre-existing damage to the premises or to items you ask us to remove.

8.4 We will not be liable for damage arising from the movement of items where you have instructed us to proceed despite a known risk, such as extremely tight access, fragile structures or unsuitable staircases.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

9.2 Subject to clause 9.1, our total aggregate liability to you arising out of or in connection with any single collection or series of related services, whether in contract, tort or otherwise, shall not exceed the total charges paid or payable by you for the relevant services.

9.3 We are not liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity, loss of data or loss of goodwill arising from or in connection with our services.

9.4 We shall not be liable for any delays or failures in performance resulting from events beyond our reasonable control, including but not limited to extreme weather, traffic disruption, accidents, vehicle breakdown, industrial disputes or governmental actions.

9.5 You are responsible for ensuring that any items you ask us to remove are waste and are not required for future use. We accept no liability for the removal or disposal of items that you later claim were removed in error, provided that such items were not clearly identified as excluded from removal at the time of collection.

10. Complaints

10.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible with full details of your complaint.

10.2 We will investigate your complaint and aim to respond within a reasonable timeframe. Where appropriate, we may offer a remedy such as a partial refund, re-visit or other corrective action, at our discretion.

10.3 Submitting a complaint does not entitle you to withhold payment for services rendered unless we have expressly agreed otherwise in writing.

11. Data Protection and Privacy

11.1 We may collect and process personal information about you in the course of providing our services, including your name, contact details, address, payment details and service history.

11.2 We will use your personal information only for the purposes of administering your booking, providing services, taking payment, handling enquiries and complying with legal obligations.

11.3 We will take reasonable steps to keep your information secure and will not sell your details to third parties. We may share your information with service partners or regulatory bodies where necessary to deliver the services or comply with law.

12. Intellectual Property

12.1 All content, branding, logos, text and materials used in connection with London Rubbish Removal are protected by intellectual property rights belonging to us or our licensors.

12.2 You may not reproduce, copy or use our branding or materials for any commercial purpose without our prior written consent.

13. Termination

13.1 We may suspend or terminate the provision of services to you with immediate effect if you materially breach these Terms and Conditions, including non-payment, abusive behaviour toward our staff, or presenting unlawful or dangerous waste.

13.2 Termination does not affect any existing rights or obligations that have accrued up to the date of termination, including your obligation to pay any outstanding sums.

14. Changes to Terms and Conditions

14.1 We reserve the right to amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of the change.

14.2 For ongoing or account customers, we will notify you of significant changes where reasonably practicable. Continued use of our services after notification will constitute acceptance of the revised terms.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising in connection with these Terms and Conditions or the provision of our services.

16. General Provisions

16.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.2 No failure or delay by us in exercising any right or remedy shall operate as a waiver of that right or remedy, nor shall any single or partial exercise preclude any other or further exercise of that or any other right or remedy.

16.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another suitable service provider, provided that this does not materially affect the standard of service.

16.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of rubbish removal and waste collection services and supersede any prior understandings, arrangements or representations.
